If you purchased Cytosport Muscle Milk ready-to-drink shakes or powder drink mix, then you may be entitled to cash! Because, a the manufacturers have agreed to pay consumers for alleged false and/or misleading claims about their product. According to a Press Release about an hour before this was first published (July 2, 2020), claims are now open!
What is a class action lawsuit settlement?
A class action lawsuit is one with multiple plaintiffs. In other words, there are more than one person being represented by the lawsuit. What’s this settlement about?
This lawsuit is about whether Defendant made false and misleading representations about the protein and fat contents of the Defendant’s protein shakes and powders.
Defendant denies any wrongdoing and denies the Plaintiffs’ allegations. Additionally, the Defendant is settling to avoid the expense, inconvenience, and inherent risk of litigation, as well as the related disruption of its business operations.
What Products are Included? Where were they sold?
The Shake Class
You’re in the Shake Class if you purchased these products from January 23, 2011 to May 5, 2020. Or, if you’re in Michigan, the starting date of the class period will be January 23, 2009. Products which had the phrase “lean lipids,” “lean protein,” “lean muscle protein,” or “new leaner formula” on the label:

- Monster Milk: Protein Power Shake
- Genuine Muscle Milk: Protein Nutrition Shake
- Muscle Milk Pro Series 40: Mega Protein Shake
The Powder Class
You’re in the Powder Class if you purchased these products from January 23, 2011 to December 31, 2018.
- Muscle Milk: Lean Muscle Protein Powder
- Light: Lean Muscle Protein Powder
- Naturals: Nature’s Ultimate Lean Muscle Protein
- Muscle Milk Gainer
- High Protein Gainer Powder Drink Mix

Who is eligible for a refund?
If you purchased any of the following products during the indicated time period, then you are a class member. To be included, you must file a claim.
Is a receipt required?
If you do not have receipts, then you can still file a claim.
How much will I get back?
Shake Class Members will be entitled to submit a claim for $1 per purchased Shake Class Product. Maximum claim is $25 with no proof of purchase; however, with receipts there is no cap. In other words, if you have your receipts, then you can get $1 per product for as many products as you purchased.
Powder Class Members will be entitled to submit a claim for $3 for each purchase of a product weighing 2 ¾ lbs. or less and $5 for each purchase of a product weighing more than 2 ¾ lbs. Maximum claim is $25 without receipts. Or, if you have receipts there is no maximum. In other words, with proof of purchase you can get $3 or $5 per product for as many products as you bought.
When will I get my check?
All payments to Settlement Class Members who submit valid Claims will be made after the later of
- the Claims Deadline (9/16/2020), or
- the Settlement Approval Order and Final Judgment becoming final
If there is an appeal of the Settlement, then this may take some time. All Settlement Class Members who do not opt out of the Proposed Settlement and who submit a valid claim will receive a cash award as set forth above.
