The United States District Court for the Eastern District of Missouri (Judge Henry E. Autrey) has conditionally certified the Settlement Class for settlement purposes only. The case is known as Pearlstone v. Wal-Mart Stores, Inc., Case No. 4:17-cv-02856-HEA [E.D. Mo.].
What is a class action lawsuit settlement?
A class action lawsuit is one with multiple plaintiffs. In other words, there are more than one person being represented by the lawsuit. Oftentimes a plaintiff or plaintiffs file the case on behalf of many people who were affected by aren’t involved in the actual suit. For example, if you purchased an item that was later determined to be involved in a class action lawsuit, you may be entitled to compensation.
If you’re included in the class or group of people affected, then you can file a claim to receive money, coupons or replacement products. Each case is different, and each will specify who is included.
In addition, class action lawsuits may require proof that you are part of the group of affected people. In this case, proof of purchase or other specified proof is needed. However, in some cases, no proof is required. In that case, you can file a claim without proving that you are part of the class of people affected. Of course, when you file a claim you are doing so under penalty of perjury. So, do not file if you do not qualify.

What’s this settlement about?
The lawsuit alleges that Walmart violated the law by failing to provide a full refund in cash or store credit to some customers who were owed a full refund under Walmart’s return policy, and specifically that Walmart miscalculated and under refunded the sales taxes that those customers originally paid for the items they returned.
Who is eligible for a refund?
All individuals who, between July 17, 2015 and November 25, 2020, returned an item purchased from a Walmart store, Sam’s Club store, or online from Walmart.com or Samsclub.com for pickup or delivery within the United States, and to whom Walmart or Sam’s Club gave a refund or credit, but the amount of sales tax refunded or credited was less than the full amount of sales tax paid at the time the item was purchased.
On the claim form, it asks if you returned a purchase within the timeframe of the case. And, if that refund was less than the purchase price with tax. In order to qualify, your answers must be Yes and Yes.
Is a Receipt or Proof Required to File a Claim?
No. If you do not have receipts, then you can still file a claim.
How much will I get back?
Walmart has agreed to pay a class settlement amount of $5,000,000 into a Settlement Fund. Settlement Class Members who timely file a valid claim will be eligible to receive an equal share of the money remaining in the Settlement Fund after deductions for the costs of settlement administration, attorneys’ fees and litigation expenses, and an incentive award for the Settlement Class Representative.
The exact amount of payments to each Settlement Class member is unknown at this time; the final amount of each payment will depend on the number of claims submitted and the amount available in the Settlement Fund after the deductions.
When will I get my check?
The final approval hearing is currently set for Wednesday, April 21, 2021, at 11 a.m. in Courtroom 10N of the Thomas F. Eagleton U.S. Courthouse, 111 S. 10th Street, St. Louis, MO 63102. At that time, they will determine when and if payments are sent.
